Finally some good news for consumers Court of Cassation, in line with Community law, determined that the consideration that citizens must pay for the collection and disposal of waste, is a tax and not a fee. Being a tax on value added tax (VAT) paid by Italian citizens is illegal.
The Supreme Court in fact stated that: "The acts with which the operators claim the creditors can show the intrinsic nature of administrative acts. It follows that they must possess all the basic measures of taxation and, in particular, the reasons justifying The request for payment of the manager. "
For example, an average family that pays a fee of 1,000 euro per year for waste disposal, it pays to his community of 100 € VAT illegitimate (equal to a rate of 10%), multiplied by 10 years (the maximum that can be requested) amounted to 1,000 € thrown in the garbage!
